Dallas-Area Saturn Dealer Sues 12 Consumers

Saturn of Lewisville, claiming to be a successor-in-interest to the rights (for purposes of a lawsuit) of Saturn of Irving, recently filed a lawsuit against 12 consumers.  Saturn of Lewisville claims that twelve people who purchased vehicles from Saturn of Irving, along with the finance company providing financing for the sales, never paid for the vehicles.  The finance company, Metropolitan Finance, LLC (“Metropolitan”), and the Texas Department of Transporation were also named as defendants.  A copy of the petition is here – Saturn of Lewisville v. Five Soldiers Sue Kansas Car Dealer

Five members of the United States Army filed suit last week against Dick Edwards Auto Plaza, Inc. and others in the United States District Court for the District of Kansas.  The plaintiffs allege among other things that the purchase price for each of their respective cars included the price of optional equipment not on the cars.  They list what they term as “phantom options:”  high-end stereo systems, power sunroofs, power seats, anti-theft systems, leather seats, and upgraded wheels.

The plaintiffs allege among other claims violations of the Truth in Lending Act and the Kansas Consumer Protection Act.  The plaintiffs are represented by Michael M. Shultz of Kaup & Shultz in Lawrence, Kansas.  Our firm has no knowledge as to the truth of the plaintiff’s allegations.  A copy of their federal court complaint is here -
