Texas Dealers – Alleged Legal Violations

The Texas Department of Motor Vehicles handles complaints by consumers and others against car dealers.  Some of the complaint records, and information about disposition of the complaints, is public record.  Here are a few for March, 2009.  The violations are just the State’s allegations, and the final agreed order does not indicate that the State made any findings of fact.  The dollar amount is that agreed by the dealer to be paid to the State.

  • Carmax Auto Superstores, Inc. – 08-0736-ENF - allegedly misused buyer’s temporary cardboard tags, failed to post a copy of the General Distinguishing Number certificate, failed to make records available for inspection by a representative of the Motor Vehicle Board at the dealer’s location, 2 counts of failing to collect and remit required motor vehicle sales tax, and failing to provide a buyer with a receipt for application for title and to report the sale of a motor vehicle in a timely manner – paid $4,000.00
  • Russell & Smith Ford, Inc. – 08-0747-ENF – allegedly misused a dealer’s temporary cardboard tag – paid $500.00
  • Meador Chrysler Plymouth, Inc. – 09-0233-ENF – allegedly failed to keep complete records, failed to report the sale of a motor vehicle, failed to remit required motor vehicle sales tax, and failed to provide a buyer with a receipt for application of title – paid $1,000.00
  • Westway Ford – 09-0360-ENF – allegedly advertised a price that is not the price for which the vehicle will be sold to any retail buyer – paid $2,000.00
  • McDavid Nissan – 09-0447-ENF – allegedly misused a dealer’s temporary cardboard tag – paid $1,000.00
